AGNES M. STERN v. DAVID STERN

Divorce — For Adultery — Evidence.

In a suit by a husband for divorce on account of the wife’s alleged adultery with the husband of the wife’s deceased sister held that the charge of adultery was not sustained, the wife’s visits to her brother-in-law’s home, and stay there after she left her husband, and her occasional riding in an automobile with her brother-in-law, being compatible with her innocence, and this being testified to by the elder children of the brother-in-law, and by an intimate friend of the deceased sister, and her visits to the brother-in-law’s home being dictated largely by a desire to help his daughters.

Decided December 10th, 1937.

Appeal from the Circuit Court of Baltimore City (SOLTER, J.).

Bill by David Stern against Agnes M. Stern. From a decree for plaintiff, defendant appeals. Reversed in part and affirmed in part.
